01Who is responsible
You are. Dialgem is a tool. The business that places or answers a call decides whether it is recorded or transcribed, whether the person was told, and whether the law allowed it. Achroweb Solutions does not know where the people on your calls are, and does not check that your calls are lawful.
02What the platform gives you
- Recording is per agent. When it is off, the recording tap is never attached — audio is not captured and then discarded.
- Transcript controls. Skip transcript storage, or store it with personal data redacted.
- Retention windows. Set a number of days; a background sweep deletes expired recordings and transcripts.
- You write the opening. The first thing your agent says is yours, so you can announce that it is an AI and that the call may be recorded.
Those are the controls. Using them correctly is on you; none of them makes a call compliant by itself.
03A starting point on the rules
| Where | Recording | Notes |
|---|---|---|
| Most US states and US federal law | One-party consent | Allowed if one participant (you) consents — but a call crossing into an all-party state is judged by the stricter rule. |
| California, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania, Washington and others | All-party consent | Tell everyone and get agreement, typically at the start of the call. The list changes; check current law. |
| UK | Lawful if the parties are told, or for narrow business purposes | Interception rules and UK GDPR apply. Tell callers at the start of the call. |
| EU / EEA | Needs a lawful basis under GDPR and national law | Transparent notice is expected, and some countries require consent or specific purposes. |
| Canada, Australia, India and many others | Varies, often needs consent | Several treat undisclosed recording as an offence. |
Calling is regulated separately from recording: marketing calls, autodialled calls and artificial or prerecorded voices need consent or a specific basis in many places (for example the US TCPA, which the FCC has applied to AI voices, and UK PECR). Honour opt-outs and do-not-call lists, and keep within permitted calling hours.
04Telling people it is an AI
A growing number of laws and regulators expect, or require, disclosure when a person is talking to an AI, and our Acceptable Use Policyforbids denying it when someone sincerely asks. The simplest safe practice is to say it in the first sentence — for example, “Hi, this is an automated assistant calling for Example Co. This call may be recorded.” — and to provide a clear way to ask for a person or to stop calls.
05Before you go live
- Know where the people you call are, and which consent rule applies to each.
- Put the AI and recording notice in the agent’s opening line.
- Turn recording and transcripts off for any agent that does not need them.
- Set a retention period you can justify.
- Check your contact list for consent and against do-not-call registers.
- Make opt-out work: the agent should end the call and your list should stop it recurring.
- Keep your own record of the consent you relied on — we hold call data, not the legal basis for it.
- Use our Data Processing Addendum and publish your own privacy notice describing the AI calls.
